PARK CITY BAR ASSOCIATION BOARD MEETING
JANUARY 17, 2002
PRESENT: Barbara Sharp, Christina Miller, Kathy Kinsman, Mark Kozak.
ABSENT: Dwayne Vance, Sam Adams, Lade Heaton, Frank Normile (presumably
tied up with Schloc and /or Festies.)
Christina called the meeting to order sans Dwayne, after a brief discussion
as to whether or not the bylaws required a quorum and/or Dwayne. Although
no one had a copy of the bylaws handy, it was decided we did not. Kathy
questioned last November’s minutes in which there was mentioned
possible coordination between a CLE activity sponsored by And Justice
for All. Barbara was supposed to pass the letter from AJFO on to her
in November, but forgot.
CLE and Ski: Christina reported that Mike Murphy,
Judge Koz, Judge Orme, and Judge Hilder can all attend. Christina is
trying to pull strings to get Judge Koz at Marriott Mountainside, ditto
Kathy at the Lodges at Deer Valley. Christina is drafting the hypos
with assistance of Charles Gruber at the USB, who is actually no longer
with the bar but has joined the ranks in private practice. He was asked
to participate, but deferred as he was no longer an Official Ethics
Guy from the USB, and suggested Billy Walker. We need a practitioner,
Tom Karrenberg bailed. Suggestions: Dan Berman, Mary Ann Wood, Pat Christensen
and Jeff Hunt (Pat and Jeff are with Parr Waddoups), Facilities at PCMR
are great, they will block off a portion of Legacy Lodge for lunch,
but everyone free to go elsewhere on the mountain. $35 for the ½
day, may be lower. Apres ski reception at the bar, also blocked off.
Lunch tickets—have max amount of $20, also have a 3 drink ticket
for the reception. Christina had a draft of a reservation sheet, have
contacted the Nevada bar for mailing list information. Will mail to
4000 Utah attorneys. Mark’s firm and TVM will pony up $500 each,
also bank. ABA Young Lawyers Western Division is having a meeting in
SLC that weekend, there is a possibility for a joint venture with them
(Mark tactfully described their current schedule of activities that
weekend as “fluid”). He volunteered the services of his
law partner, Vicky Bushnell who is president of the Utah ABA section,
to investigate. Prices for the CLE will remain at its previous level
of: $150 for members, $175 non-members.
KPCW annual fundraiser: Can’t do it Valentines
Day due to the SLCWO, but is doing it next week. Asked for a donation.
Joe Tesch on behalf of TVM,. will donate $500 if the PCB will. Need
someone to go on radio on Tuesday the 22 January drive time 5-7 p.m.
Mark tentatively volunteered Vicky again, who is in Mexico. Kathy moved
to donate $500, Mark seconded, and it was passed.
TNB: January 8 meeting moved to library after Sundance
folks kicked us out. Barbara never could find the group at the library.
There were about 5 clients. February is cancelled due to the Olympics,
so next meeting is March 5.
PCBA next meeting: regular meeting date in Feb is
during the SLC WO, so it was decided to bail on February. If Dwayne
has heartburn about that, particularly in light of the fact that this
would mean no meeting before the March 8 Ski CLE, he will contact everyone.
Otherwise, Christina will keep us apprised via email for decisions,
etc. re Ski CLE.
Kathy on CLE: last few events went well. Dave Thomas
did a power point on the Olympic Court. It appears that there are a
lot of things still not worked out on the Olympic Court situation, such
as mass arrests. Resident lien recovery fund was the December topic,
Tara Isaacson did DUI in November. Nothing scheduled for April, Christina
suggested judgment collection, which USB has done before. Possibly Christina
can do protective orders in May, re the new stalking statute.
New law proposed for justice courts, appointment basis by County commissioners
at their pleasure (no terms). In past, this has resulted in rampant
abuse in appointing judges that favor the county’s point of view.
Things have not changed for the better since then, with a lot a controversial
land use type issues about. The concern is that the commissioners will
simply oust any judge who has the temerity to rule against their interests,
and will give new meaning to the term “judge in their pocket.”
Need help to oppose, to keep it on a retention basis. rather than at
the whim of the county commission. Christina will keep us apprised as
to what can be done to flex our collective muscles against this proposal.
Treasury: Mark hasn’t seen a bank statement
in 2 months. Will stop by Frontier Bank and inquire. Tassie stated that
a few things have come in from unknown sources, which were passed on
to Dwayne, and brought in a file from Dwayne’s lair. Viola! Wells
Fargo statements, Matthew Bender invoice. But still nothing from Frontier
Bank. Other than the dearth of bank records, we are in good financial
shape.
Possible golf CLE in the summer, particularly in light of new courses.
Attorney directories: for some reason John Fay is
in control and is not forthcoming with copies for the PCB.
Dwayne arrived at 9:21 am, after having a somnolent emergency which
precluded his timely arrival.
Meeting was adjourned at 9:23 am.
