TYPICAL DUTIES: The Utah Appellate Courts are seeking an attorney to join their staff. Responsibilities include drafting proposed per curiam dispositions and providing assistance to the court regarding docketing statements, motions, applications for certificates of probable cause, petitions for interlocutory appeal, and petitions for extraordinary writ.

MINIMUM QUALIFICATIONS: Graduation from an ABA accredited law school with a juris doctorate degree plus three years experience in the practice of law. Must be a member in good standing of the Utah State Bar. Thorough knowledge of principles of the appellate process, Utah statutes, procedural and evidentiary rules, general legal principles and common law procedure. Must possess the ability to identify and analyze legal problems within the context of the appellate process and propose sound dispositional recommendations. Excellent writing skills required.

Sean Reyes - Named National Outstanding Young Lawyer

As an update to this post, Sean Reyes has been chosen by the Young Lawyers Division of the American Bar Association to receive the 2006-2007 National Outstanding Young Lawyer Award. The award will be presented to Sean at the February 2008 Midyear Meeting of the American Bar Association in Los Angeles, California.

Sean was selected after the American Bar Association reviewed nominations received from all over the country. The award is presented to a young lawyer who exhibits professional excellence, service to the profession and the bar, service to the community, and/or a reputation for the advancement of legal ethics and professional responsibility.

This is the first year the ABA has presented this award, so it is a special honor to have the first award go to an attorney from Utah.

Medical Malpractice Pre-litigation Panel Review Chairpersons Needed

The Division of Occupational and Professional Licensing is seeking attorneys who are licensed and in good standing in Utah to serve as chairpersons of medical malpractice prelitigation review panels. Prelitigation review is a condition precedent to commencing litigation under the Utah Health Care Malpractice Act. Panels are composed of an attorney, who serves as the chairperson; a lay panelist; and a health care provider who is practicing and knowledgeable in the same speciality as each proposed defendant.

Chairperson must be available to serve on 3-5 panel hearings per month, each of which are normally restricted to two hours in length. Chairpersons responsibilities include conduction the panel hearing and drafting a supplemental panel opinion following the hearing. Training will be provided.

This is a perfect opportunity for attorneys interested in medical malpractice to learn the profession. This is not a paid employment position; however, chairpersons receive a standard State of Utah per diem and are reimbursed for travel and parking expenses. Letters and resumes must be received no later than December 31, 2007.

November - National Adoption Month

November is National Adoption Month. The Utah Adoption Council, along with help from the Needs of Children Committee of the Utah Young Lawyers Division, is hosting two events on Saturday, November 3, 2007. Both events will be held at Boondocks in Draper.

The first will be held from 9:30 a.m - 11:00. and is exclusively for families who are interested in adopting an older child. Families must be licensed through the state or close to it. Profiles and photos of waiting children in Utah will be available. Staff from both Utah's Division of Child and Family Services, as well as the Adoption Exchange, will be available to answer questions. More information is available here.

The second event will be held from 11:00 - 1:00 on that same day, also at Boondocks. This event is for everyone to celebrate adoption in general. Further information is available here.

The Needs of Children Committee needs two volunteers for this activity to help set up from 9:00 -11:00 and two volunteers to come at 12:45 to help with the take down. If you are interested in helping, contact David Johnson at davidlj@email.utcourts.gov.

High School Debate Tournament

The YLD is proud to sponsor the Young Lawyers High School Debate Tournament, Oct. 26-27 at West High School in SLC (note that this is a new location from years past), now in its third year, bringing together hundreds of Utah high school students for two days of team debate and speech events.

For generations, debate has served as a launching pad for students interested in becoming lawyers. YLD’s involvement with high school debate provides a positive first contact point between students and the Bar. Lawyers, former high school and college debaters, will judge team debate finals. YLD is recruiting sitting judges from Utah’s state and federal courts to judge public forum debate finals. Help needed for research project

Russell Wood, a communications doctoral candidate student at the University of Utah is conducting a research project and is looking for attorney volunteers to assist in the research. As part of his research he is looking for attorneys that would be willing to participate in a research study to better understand what occurs during negotiation. Much of the available information on negotiation is based on subjective statements of opinion or reports of practice. Academic research attempts to develop a more objective understanding of negotiation. This study proposes to consider negotiation from a relational communication perspective with the intent of offering new insights into negotiation practices.

Participation would include about an hour of time (including travel) where you would negotiate a mock case with another lawyer for about 20 minutes. The communication between the two lawyers (not the outcome of the negotiation) would be studied and analyzed by the researcher after you are gone. The researchers anticipate that the information developed in the study (and subsequent academic publications) will help professionals, and people in general, to have a better understanding of negotiation. Hopefully, for many people that will lead to an improved negotiating experience, better skills, and more productive outcomes from negotiation.
