      Salt Lake City, UT—Mary Aguirre-Shahin, Esq., has been appointed as the new director of the Utah Judicial Institute, which is the education arm of the Utah State Courts. Shahin replaces Diane Cowdrey who accepted a position with the Administrative Office of the Courts in California. In her position with the Utah State Courts, Shahin will oversee the development of judicial education programs for judges and court staff throughout the state. 
      Prior to joining the Utah State Courts, Shahin worked in Afghanistan as a legal advisor for a U.S. State Department judicial reform project.  In that capacity she trained prosecutors and police officers and conducted the first ever comprehensive assessment of the judiciary in northern Afghanistan. Before this, she worked closely with the Ministry of Justice in Jordan on a USAID judicial reform project.  In 2004, Shahin served as general counsel to the Supreme Court of Micronesia where she developed training programs for Pacific Island judges. She has also worked for the American Bar Association where she assisted with the first ever Judicial Education Conference for more than 400 judges in the kingdom of Jordan. 

Shahin began her work in judicial education in 1998 at the National Judicial College in Reno, Nevada, where she developed award-winning judicial education programs. Her innovative “Courage to Live Judicial Outreach Education Program,” received national awards and acclaim and serves as a model judicial outreach program throughout the country. 

Shahin is a graduate of the University of California at Berkeley and an honor law graduate of Hastings Law School in San Francisco, California. Prior to her judicial education career, Shahin worked as a trial attorney for the U.S. Department of Justice in Washington, D.C. where she was awarded the Attorney General’s Special Achievement Award.  She has practiced environmental law with California law firms whose clients included Fortune 500 companies.

Our presenters are a diverse group of well-qualified individuals from our own Bar and around the country. Our Thursday keynote speaker is <strong>Monroe Freeman</strong> who was the recipient of the American Bar Association's highest award for professionalism and is recognized as "one of the most highly regarded constitutional lawyers." Also addressing us will be <strong>Steve Wozniak</strong>, Apple Computers Inc. co-founder who started a computer revolution that has yet to slow down.  On a personal note, I always look forward to the <strong>Family Carnival</strong> - an opportunity to "kick back" with my colleagues and enjoy a good barbeque. <strong>Electronic Filing of Briefs</strong>  -  The Utah Supreme Court has established a pilot program to require submission of electronic courtesy briefs to the Utah Supreme Court and the Utah Court of Appeals.  Standing Order No. 8 is effective May 15, 2008.  Questions or inquiries should be directed to Sue Willis, Deputy Court Clerk, Utah Supreme Court, (801) 578-3900. The Divorce Education for Children class is available for children 9 to 12 years old whose parents have filed for divorce. The class is presented twice each month—one Monday evening and one Saturday—at the Scott M. Matheson Courthouse at 450 South State Street. To register for the class, parents should call Alyssa White at (801) 578-3897 or e-mail <a href="mailto:alyssaw@email.utcourts.gov">alyssaw@email.utcourts.gov</a>.  There is no charge to attend the classes. ]]>
      <![CDATA[The program’s curriculum provides children with skills they can use at home, such as how to express their feelings to parents. Mental health professionals teach the class with the assistance of state court judges and commissioners. Participation in the children’s class is voluntary.

<strong>USB 14-1001.</strong> IOLTA. Amend. Clarifies the formula for determining whether the net income from investing client funds exceeds the cost of doing so. Directs the Utah Bar Foundation to determine whether an institution is eligible for deposits. Establishes the criteria to be an eligible institution. Restricts deposits to eligible institutions and defines the types of accounts permitted. Establishes sanctions and procedures if a lawyer fails to report annually.]]>

<strong>CJA Chapter 11. Article 1.</strong> Advisory Committees and the Rulemaking Process. Amend. Creates from Rule 11-101 a series of rules. Each rule regulates a particular topic in the rulemaking process.

<strong>CJA 11-101.</strong> Creation and Composition of Advisory Committees. Amend. Adds a provision that committee members are officers of the court and not representatives of any interest.

<strong>CJA 11-103.</strong> Rulemaking Procedures. New. Recognizes reliance on written comments.

On May 1st, 2008, the Young Lawyers Division will again sponsor the annual Law Day Luncheon to be held at the Little America in Salt Lake City at 12:00 noon. The keynote speaker will be the Honorable Michael McConnell of the Tenth Circuit Court of Appeals. The Young Lawyers Division Wills for Heroes program that helps emergency first responders and their families will be provided May 2nd  from 10 a.m. to 4 p.m. in the main UTA Office located at 3600 South 700 West in Salt Lake City. Utah attorneys will meet with the police officers to create free wills, living wills and other estate planning documents. <strong>NEW PROFESSIONALISM COUNSELING PROGRAM</strong> - The Utah Supreme Court has created a professionalism counseling program for members of the Utah State Bar effective April 1, 2008.  The Supreme Court has appointed Thomas Berggren, Hon. William B. Bohling, Robert S. Clark, Ellen Maycock, and Gayle F. McKeachnie to serve on the professionalism counseling board. <strong>COURTHOUSE CONSTRUCTION</strong> - The building entrances of the Scott M. Matheson Courthouse, located at 450 South State Street are being reconstructed.  The construction will result in security enhancements as well as improved traffic flow. Construction is scheduled during the evenings and weekends to minimize delays; however, court users are encouraged to plan extra time when coming to the courthouse. Construction to the west entrance began on March 17 and is scheduled to be completed by April 8. The east entrance construction will begin on March 31 and is expected to be finished by May 22. <strong>ANNUAL AWARDS</strong> - The Board of Bar Commissioners is seeking nominations for the 2008 Annual Convention Awards. These awards have a long history of honoring publicly those whose professionalism, public service and personal dedication have significantly enhanced the administration of justice, the delivery of legal services and the building up of the profession.       <![CDATA[SUNSHINE AWARDS  -  The Utah Headliners Chapter of the Society of Professional Journalists recognized the achievements of individuals who have helped promote access to government. 

Among those selected for awards were Attorney General Mark Shurtleff; and lawyers Jeff Hunt, Michael O’Brien and David Reymann who worked together to secure approval by the Utah Supreme Court of a Shield Rule for reporters—a first for the state—that protects reporters from being compelled to divulge confidential sources.

      Salt Lake City, Utah—The Utah Court of Appeals will hold a special session in Tooele on April 11 at 10:00 a.m. The court will hear oral arguments at the Gordon R. Hall Courthouse, 74 South 100 East, courtroom 21. This is the first time the Court of Appeals has held court in Tooele. 
      <![CDATA[“Utah’s two appellate courts—the Court of Appeals and Supreme Court—hear cases primarily in Salt Lake’s Scott M. Matheson Courthouse,” said Presiding Judge Pamela T. Greenwood. “Both courts, however, on occasion will travel to hear cases in other parts of the state to give the public and students an opportunity to see the how the court operates first hand.”

The panel of judges that will preside during oral arguments is comprised of Judge Pamela T. Greenwood, who has served on the Court of Appeals since 1987; Judge William A. Thorne, Jr., who has served on the Court of Appeals since 2000; and Judge Carolyn B. McHugh, who has served on the Court of Appeals since 2005. 

The Utah Court of Appeals was created in 1987 to handle an increasing load of appellate cases facing the Utah Supreme Court. The court, which consists of seven judges who serve six-year renewable terms, hears appeals primarily from the juvenile and district courts.       Loa, UT---A panel of judges is scheduled to meet on Thursday, May 8, 2008 to hear testimony to determine if reasonable cause exists to call a grand jury. The meeting will take place in the Wayne County Courthouse, 18 South Main Street. 
      Those wanting to testify before the panel of judges should contact District Court Administrator Debra Moore at (801) 578-3800 by April 15, 2008 to schedule an appointment. Individuals testifying must be prepared to give evidence to support claims that justify calling a grand jury. Controversies between individual parties will not be considered. Individuals who need special accommodations during the hearing must notify Ms. Moore at least three business days prior to the hearing. 

Utah’s Grand Jury Statute requires a panel of judges selected from throughout the state to hold hearings in each judicial district every three years. The purpose of the hearings is to determine if a grand jury needs to be summoned based on evidence of criminal activity. The Grand Jury Panel is comprised of the following judges: Supervising Judge A. Lynn Payne, Eighth District Court; Judge Terry L. Christiansen, Third District Court; Judge Steven L. Hansen, Fourth District Court; Judge Sandra N. Peuler, Third District Court; and Judge W. Brent West, Second District Court. 

The Attorney General, a county attorney, district attorney, or special prosecutor appointed under U.C.A. 77-10a-1 can also present evidence if it is based on criminal activity. The panel of judges will hear, in secret, all persons claiming information that justifies calling a grand jury. All individuals appearing before the panel of judges will be placed under oath. If a grand jury is summoned, the jurors will be called from the state-at-large or any judicial district within the state.
