      <![CDATA[The Utah Judicial Council's rule requiring attorneys to submit filings in civil cases electronically is now in effect. CJA 4-503. Electronic filing in probate cases is available and will be mandatory on July 1. Please note the following information about the eFiling system: 

1.  The place where court's seal and signature appear on orders electronically signed by the court has changed. They now appear in the top margin of the first page of the order. 

2.  We are aware that formatting issues have been appearing in some electronically signed orders. The new signature location will help resolve some of those issues. To further reduce formatting problems, we have posted updated formatting tips for you to use in preparing documents for the court's signature: go to the court's website at <a href="http://www.utcourts.gov/efiling">www.utcourts.gov/efiling</a> and select “Formatting .RTF Documents Submitted for Court Signature.” If you need further assistance to format documents for eFiling, please contact your electronic filing service provider.

3.  New video trainings have also been posted on the court's website at the above address (select “eFiling Video Tips for Attorneys”). Each video is about three minutes long and provides interactive training on the most frequently asked questions about eFiling. Please share this information with members of your staff who prepare your filings.

      <![CDATA[Salt Lake City, UT - Nearly 12,000 Utah children are impacted by divorce each year, including more than 5,000 children in Salt Lake County. To address the needs of these children, the Utah State Courts offers a free Divorce Education for Children class twice each month. Classes take place on Saturday from 10 a.m. to noon and Monday from 6 to 8 p.m. Following are the dates for upcoming classes: April 8 and 27, May 6, June 10 and 29, 2013.  

The Divorce Education for Children class is for children 9 to 12-years-old whose parents have filed for divorce or whose parents are divorced. The class takes place at the Scott M. Matheson Courthouse at 450 South State Street.  Advance registration is required by calling (801) 578-3897 or e-mail <a href="mailto:sabrinap@email.utcourts.gov">sabrinap@email.utcourts.gov</a>. There is no charge to attend the class.

The program’s curriculum provides children with skills they can use to better communicate their feelings to parents. A mental health professional teaches the class with the assistance of a state court commissioner. Participation in the children’s class is voluntary.

The survey conducted by Dan Jones for the Bar concluded many things, one of which was that 44% (a majority of responses) of us believe the public views us negatively. Given your responses and the need to change the ongoing negative view the public holds of attorneys, the Bar has hired Sean Toomey to handle not only our advertising needs but also our public relations. The view to this hire was two-fold: improve the quality of our public relations and advertising outreach and decrease the cost to the Bar. I remain convinced that if the public knew of how much good attorneys do in the community it would go a long way to changing the view of attorneys overall. We have all heard that everyone hates all lawyers except their own. We also all know that attorneys are out in their communities serving in countless unrecognized ways. I’m renewing my request that you send in your stories, or the stories of those you know, who are serving in their communities, from coaching their kids teams to serving on planning and zoning committees. If you want to remain anonymous that is fine. But your efforts to improve the world you live in are valuable and deserve recognition, and getting the information out will serve all members in changing the overall view of lawyers in the public. <strong>Court will use your Bar e-mail address not your e-Filing e-mail address</strong> - It is critical that you keep your business e-mail address of record with the Bar current, even though you provide the same or different e-mail address to your e-filing service provider (EFSP). That email address is used only by the EFSP, and is not provided to the Court. The Court will continue to use your Bar e-mail address for: 1) docketed notices regarding discovery, hearings, and other events, in cases in which you have appeared as counsel of record, 2) other communications regarding cases in which you have appeared as counsel of record, and 3) other court communications regarding changes in court rules or other matters unrelated to a specific case. The fact that you are reading this e-mail is a good sign, but please be aware that the court will be using your “business” e-mail address, which may be different from the “preferred” e-mail address you have designated for use by the Bar. <strong>Modest Means Lawyer Referral Program</strong> - You can receive free client referrals from the Bar by offering clients with modest means a discounted rate (recommended maximum of $50 or $75 per hour depending on income); sign up at <a href="http://www.utahbar.org/modestmeans/">utahbar.org/modestmeans</a> and plan on attending a free CLE on April 11 from 3 to 7 p.m. The Modest Means program targets middle-class people who can afford to pay something for legal services, but who may not realize how important a lawyer can be in many situations. This includes families of four making nearly $70,000 without excessive assets—teachers, fire fighters, and nurses—educated, stable people who could become good, long-term clients. You can provide full-representation to Modest Means clients, but you may consider limited-scope representation as an alternate entry point to people currently not using attorneys. Limited representation could start with a few-hour consultation that might be sufficient to launch a client successfully, but may also lead to additional work, such as document review, coaching for appearances, appearances, and, in some cases, full representation. The ABA just released a resolution to “…encourage practitioners, when appropriate, to consider limiting the scope of their representation as a means of increasing access to legal services;” visit <a href="http://americanbar.org/108">americanbar.org/108</a>.

<strong>Odd Year Mandatory CLE (MCLE) Reporting Cycle (7/1/11 to 6/30/13)</strong> - Keep your skills sharp and stay in touch with your colleagues with Continuing Legal Education. Active Status Lawyers complying in 2013 need to complete a minimum of 24 hours of approved CLE, including at least three hours of accredited ethics, with one of the three in professionalism and civility. A minimum of twelve hours must be earned by attending live CLE presentations.       <![CDATA[The Supreme Court and Judicial Council have approved amendments to the following Utah court rules. The amendments are effective April 1, 2013, unless otherwise noted.

<strong>Summary of amendments</strong>
<strong>Code of Judicial Administration</strong>

CJA 04-0503. Mandatory electronic filing. Amend. Requires the electronic filer to use a personal identity with an e-filing interface, rather than someone else's. Will not prohibit a paralegal or administrative assistant from filing on an attorney’s behalf.

CJA 04-0508. Guidelines for ruling on a motion to waive fees. New. Establishes guidelines for ruling on a motion to waive fees. Requires use of court-approved forms.

CJA 11-0201. Senior judges. Amend. Removes reference to the Judicial Council's attorney survey for certification of senior judges.

<strong>Rules of Civil Procedure</strong>

URCP 005. Service and filing of pleadings and other papers. Amend. Requires a certificate of service appended to each document that has to be served. Permits the court to serve documents by email. Email to lawyers will be to the email address on file with the Utah State Bar.

URCP 010. Form of pleadings and other papers. Amend. Requires designation of the discovery tier in the caption of a claim. Requires a court-approved coversheet for counterclaims and cross claims as well as complaints.

URCP 011. Signing of pleadings, motions, affidavits, and other papers; representations to court; sanctions. Amend. Deletes a provision that conflicts with Rule 26(e). The consequence will be that the signature on disclosures, discovery requests and discovery responses is a certification under Rule 11.

URCP 026. General provisions governing disclosure and discovery. Amend. Changes the time for initial disclosures. Provides for timing of disclosure and discovery of rebuttal experts. Clarifies that disclosure and discovery documents must be served.

URCP 026.02. Disclosures in personal injury actions. Amend. Narrows the limitation on the further use of disclosures to Plaintiff’s Social Security number and Medicare health insurance claim numbers. In a committee note, describes the committee's intent regarding the scope of the rule.

URCP 037. Discovery and disclosure motions; Sanctions. Amend. Allows the court to enter sanctions if a motion for a protective order or motion to compel is denied.

URCP 105. Shortening 90 day waiting period in domestic matters. Amend. Changes the standard of "good cause" to "extraordinary circumstances" in keeping with Section 30-3-18.

<strong>Rules of Juvenile Procedure</strong>

URJP 020. Discovery generally. Amend. Provides that the financial disclosure requirements of the civil discovery rule does not apply in juvenile court unless ordered.

<strong>Rules of Small Claims Procedure</strong>

URSCP 003. Service of the affidavit. Amend. Permits a small claims affidavit and summons to be served by any method of personal service authorized by URCP 4. Allows alternative service in a small claims case.

      <![CDATA[The Utah Judicial Council rule requiring electronic filing in civil and domestic cases will be in effect on Monday, April 1. On April 1 the district court will no longer accept paper documents for filing from attorneys in civil cases other than probate. 
The Board of District Court Judges has decided that no grace period or other exceptions to the mandatory e-filing rule will be allowed. The rule will be strictly enforced on the effective date. On April 1, documents brought to the courthouse will not be accepted for filing. Documents left in a night dropbox or received in the mail that are time-stamped or postmarked after 11:59 p.m. on March 31 may be destroyed.
To begin efiling, attorneys must set up an account with any of the following certified efiling service providers:

<strong><em>Modest Means Program</em></strong>
The Utah Courts are currently seeing an explosion of cases with pro se litigants. They cannot afford full-priced legal assistance, but do not qualify for pro bono legal services either. Programs and services like public defenders, Utah Legal Services, Legal Aid of Utah, the Disability Law Center, and legal clinics throughout the state admirably provide limited legal representation for the poorest members of our community but, for a large segment of the middle class, obtaining affordable legal services is more difficult. To an increasing segment of society, we are viewed as being out of reach. We also have attorneys who are experiencing a downturn in their practices given the economy, or new lawyers looking to create or expand their practices. The Bar Commission has created a program to match the unmet need of clients and the available time of attorneys. The Utah State Bar Modest Means Program is designed to bridge the gap and match paying clients with attorneys who want to supplement their clientele, but are willing to charge lower fees to these modest means clients. The program will focus on needs most commonly encountered at the courts, including family, landlord/tenant, consumer, and criminal law. We have started taking referrals through the program and are in need of more attorneys, both to work for clients and to advise younger attorneys in need of experienced assistance; please join us at <a href="http://www.utahbar.org/modestmeans/ ">http://www.utahbar.org/modestmeans/ </a>

1.<strong>Bar Day at the Legislature</strong> - The Utah State Bar is presenting its Annual Bar Day at the Legislature CLE on Tuesday, February 19th from 9:00 am to 12:15 pm at the State Office Building Auditorium. Presenters include Senate President Wayne Niederhauser, House Speaker Becky Lockhart, Lt. Governor Greg Bell and Chief Justice Matthew Durrant. Topics will cover current issues facing the state government, Utah's financial environment, the legislative process and communication with legislators. The event is approved for 3 hours of CLE. Early registration will be $50 and must be received by Friday, February 15th. (Registration will increase to $75 for those registering after the 15th.) Attendance is limited to the first 100 registrants. 5.<strong>MCLE Reminder of Odd Year MCLE Reporting Cycle</strong> - July 1, 2011 – June 30, 2013 Active Status Lawyers complying in 2013 are required to complete a minimum of 24 hours of Utah approved CLE, which shall include a minimum of three hours of accredited ethics.       <![CDATA[As Chief of the U.S. Citizenship and Immigration Services (USCIS), Office of Transformation Coordination, I want to personally inform you of enhancements to the agency’s electronic immigration system, known as USCIS ELIS. On May 22, 2012, USCIS launched the foundational release of USCIS ELIS, which provides a streamlined, Web-based process for individuals, attorneys, and accredited representatives to submit and track their benefit requests. As of January 14, 2013, new USCIS ELIS features allow attorneys and accredited representatives to electronically interact with clients, who can now verify, review, and e-sign their benefit requests. The new system features are part of our continuous effort to better serve our customers and move USCIS to an electronic environment. USCIS ELIS will gradually expand to include more features and functions until most types of immigration benefit requests can be electronically filed.

JUDGE HADFIELD NAMED PRESIDING IN FIRST JUDICIAL DISTRICT
Logan, UT---Judge Ben H. Hadfield has been named presiding judge for the First District Court for a two-year term. Judge Hadfield replaces Judge Clint Judkins who is retiring. Judge Jeffrey R. Burbank will remain as Associate Presiding Judge.
The presiding judges are responsible for the effective operation of their courts. According to court Rule 3-104, presiding judges are responsible for implementation and enforcement of statutes, rules, policies, and directives of the Utah Judicial Council as they pertain to the administration of the courts. The presiding judge is responsible for assigning cases and judges.
Presiding judges and associate presiding judges are elected by a majority vote of the judges of their court. When the presiding judge is unavailable, the associate presiding judge assumes his or her responsibilities.

<strong>COURT VISITOR PROGRAM PLANS FREE FILM SCREENING</strong>
Salt Lake City, UT - The Court Visitor Volunteer Program is planning a free screening of the documentary film Last Will and Embezzlement on Feb. 13 at 6:30 p.m. at the Salt Lake City Library’s Nancy Tessman Auditorium. The documentary is a film about the financial exploitation of vulnerable adults and covers first-hand accounts from victims as well as interviews with experts who discuss potential solutions to the growing problem.
The Court Visitor Volunteer Program is a pilot guardianship monitoring program established by the Utah Judicial Council in 2011. It is funded by a grant from the State Justice Institute. The purpose of the program is to protect vulnerable adults from abuse, exploitation, neglect, and self-neglect. The program aims to preserve an individual’s independence and self-determination despite diminished capacity. The program currently operates in the 3rd, 4th, and 7th judicial districts.
A panel discussion will follow the film at which representatives from Adult Protective Services, the Salt Lake City Police Department, and the Utah State Courts will participate.       Efiling Release Successful

Utah State courts announced that, as of January 12, 2013, domestic relations cases and probate cases are available for electronic filing (efiling). 

Mandatory efiling for attorneys begins on Monday, April 1st, 2013. Utah District Courts will require that all pleadings and other papers filed by an attorney in general civil and domestic relations cases be electronically filed. Paper filings will not be accepted after Friday, March 29th, 2013. Efiling in probate cases will be mandatory beginning July 1st, 2013. 

If an attorney or law firm submits, on paper, any document that is required to be filed electronically, the clerk will return the document to the filer. Read the rule below. To ensure that you are prepared and able to meet the mandatory efiling dates, open an account now and learn to efile. Certified Electronic Filing Service Providers (EFSP) are:

CJA Rule 4-503. Mandatory electronic filing.

(1) Except as provided in Paragraph (2), pleadings and other papers filed in civil cases in the district court on or after April 1, 2013 shall be electronically filed using the electronic filer’s interface.

(2)(A) A self-represented party who is not a lawyer may file pleadings and other papers using any means of delivery permitted by the court.

(2)(B) A lawyer whose request for a hardship exemption from this rule has been approved by the Judicial Council may file pleadings and other papers using any means of delivery permitted by the court. To request an exemption, the lawyer shall submit the request to the Judicial Council’s General Counsel on a form approved by the Judicial Council.

(2)(C) Pleadings and other papers in probate cases may be filed using any means of delivery permitted by the court until July 1, 2013, at which time they shall be electronically filed using the electronic filer’s interface.

CJA 02-0206. Effective date of rules. Amend. Designates May 1 and November 1 as the presumed effective date of Judicial Council rules.
CJA 04-0610. Appointment of justice court judges to preside at first appearances, preliminary hearings and arraignments. Amend. Technical amendment.
CJA 07-0304. Probation supervision. Amend. Changes the time for filing and reviewing supervision plans. Includes the Balanced and Restorative Justice Model throughout the case planning process.

      <![CDATA[<strong>UTAH STATE COURTS PLAN JUDGE FOR A DAY PROGRAM</strong>
Salt Lake City, UT—The Utah State Courts are planning the 8th Annual “Judge for a Day,” program in recognition of Law Day, which is celebrated on May 1, 2013. On May 1, 1958, President Dwight D. Eisenhower proclaimed the first Law Day as a day of national dedication to the principle of government under law.
Utah high school students are selected to participate in the program based on an essay, civic involvement resume, or teacher nomination letter. The topic, for students who choose to write an essay, is “Realizing the Dream: Equality for All.”   
Students selected to participate in the program will be paired with a judge in one of the state’s eight judicial districts for one day in either April or May. The students will be given a behind-the-scenes look at court operations, which include observing court proceedings and a judge at work.

Students are asked to submit an application form by March 4, 2013. Application forms and additional information are available on the court’s Web site at www.utcourts.gov/media/lawday.
