Rules Governing the Utah State Bar
USB 14-0802. Authorization to practice law. Amend. Conform the practice of law rule to the Rules of Small Claims Procedure.

Rules of Civil Procedure
URCP 058A. Entry of judgment; abstract of judgment. Amend. Resolves an inconsistency within the rule and directs that a judgment by confession will be signed by the clerk.

Rules of Juvenile Procedure
URJP 056. Expungement. Amend. Remove provisions governed by other laws. Amend requirement for criminal history verifications to judicial discretion.

Code of Judicial Administration
CJA 02-0103. Open and closed meetings. Amend. Clarify that a meeting can be closed to discuss the professional competence of an individual and add discussion of a non-public document as grounds to close a meeting.
CJA 04-0202.02. Records classification. Amend. Classify a record of a Children's Justice Center investigative interview as a protected record before the conclusion of legal proceedings and as a sealed record after the conclusion of legal proceedings.
CJA 04-0202.06. Response to request to access or classify a court record. Amend. Incorporate amendments to GRAMA by HB 278 and HB 133. Require that, if a records request claims to qualify for an expedited response, the records custodian will, within 5 business days, respond or notify the requester that the request does not qualify. If the request is to access a record of a Children's Justice Center investigative interview, refer to Section 77-37-4.
CJA 04-0408.01. Responsibility for administration of trial courts. Amend. Designate Manti as a state court operation rather than by contract with the county.
CJA 04-0702. Electronic citations required. New Require that citations filed after January 1, 2012 be filed electronically.
CJA 07-0308. Expungement procedures. Repeal. All provisions of this rule are contained in URJP 56 or Section 78A-6-1105.

      Heber, UT— Heber City Mayor David Phillips has appointed Randy B. Birch, of Heber City, to fill a vacancy in the Heber City Justice Court. The position will replace Judge Reed Parkin who has been appointed to the Orem City Justice Court effective Sept. 1, 2010.
 
      Randy Birch works as a solo attorney in Heber City. He previously practiced law in Salt Lake City with the law firms of Bostwick &amp; Price, Bertch &amp; Birch, and Walstad &amp; Babcock. Birch has more than 26 years of experience primarily in constructed-related commercial law. Since 2007, Birch has taught the substantive law portion of training for the Administrative Office of the Courts, Justice Court judges, and judges pro tempore. 

Birch has served as a small claims judge in Salt Lake and Summit counties for the past 25 years. He has written numerous articles for several publications and local newspapers on a variety of topics. Birch received a J.D. degree from the University of Utah College of Law and a B.A. degree from Utah State University. He is a member of the Utah State Bar, American Bar Association, and the Utah Association for Justice. He also serves on the Board of the Utah Association of Criminal Defense Lawyers. 

The appointment is subject to certification by the Utah Judicial Council.

      Ms. Heather Finch was the President of the Paralegal Division of the Utah State Bar and was serving as an ex-officio member of the Utah State Bar Board of Bar Commissioners. The Bar Commission and Utah State Bar Staff extend their sympathies to her family and friends.

SALT LAKE CITY -- Two women on board a plane that crashed early Tuesday in Nepal are from Utah. 

The Provo law firm of Howard, Lewis &amp; Petersen confirms two of its employees were killed in the crash.

John Valentine, managing shareholder at the firm, identified the two women as Leuzi Cardoso and Heather Finch.
      <![CDATA["For our firm it's a major tragedy because we've regarded these two people as very, very critical," Valentine told KSL Newsradio Tuesday morning.

"Both of these women were amazing leaders. Mrs. Finch was the head of the paralegal organization for the whole state. Mrs. Cardoso has been our office manager and has been very accomplished in a number of areas. We are just so saddened to lose both of them," he continued.

Profiles of both women appear on the firm's website. Valentine said it was their lifelong dream to go to the Everest base camp.

The flight carried 14 people who were headed to the region around Mount Everest. It went down in heavy rain near Katmandu.

To address the needs of these children, the Utah State Courts offers a Divorce Education for Children class twice each month at no charge to participants. Classes take place on Saturday from 10 a.m. to noon and Monday from 6 to 8 p.m. Following are the dates for upcoming classes: August 30, Sept. 11 and Sept. 20.

      <![CDATA[The Divorce Education for Children class is for children 9- to 12-years-old whose parents have filed for divorce or whose parents are divorced. The class takes place at the Scott M. Matheson Courthouse at 450 South State Street.  Advance registration is required by calling (801) 578-3897 or e-mail michelleg@email.utcourts.gov. There is no charge to attend the classes. 

The program’s curriculum provides children with skills they can use to better communicate their feelings to parents. A mental health professional teaches the class with the assistance of a state court commissioner. Participation in the children’s class is voluntary.

      <![CDATA[<strong>All Small Claims Cases to be Filed in Justice Court</strong>

Salt Lake City, UT—Beginning Sept. 1, 2010, individuals planning to file a small claims case will need to do so at their local city or county Justice Court. The only exception is some areas of Cache County that do not have a Justice Court. The change is occurring as a cost-saving measure in the state courts. ]]>
      

Presently, there is concurrent jurisdiction with the district courts and justice courts when small claims cases are filed. In a majority of counties, small claims cases are already filed exclusively in justice courts. This change will result in all small claims cases being filed in justice courts in all counties and will primarily affect counties across the Wasatch Front. 

Small claims cases filed in the state’s district courts before Sept. 1, will still be heard in the district court. District court judges will continue to hear all appeals in small claims actions. 

Small claims cases cover disputes that do not exceed $10,000. Any individual or business may file a small claims case and most litigants appear without an attorney. The location of the justice court in which to file a small claims case depends on the city/county where the defendant resides or the city/county in which the cause of action arose.

      Riverdale, Utah—Applications are being accepted for a Justice Court judge position in Riverdale City. The position will replace Judge Michelle E. Heward who has been nominated by Governor Gary Herbert for a Juvenile Court judgeship in the 2nd Judicial District. 
      To be considered for the position, candidates must be at least 25 years of age, a citizen of the United States, a Utah resident for at least three years, and have earned a high school diploma or GED. 

Information on judicial retention and performance evaluation is posted on the Utah State Court’s Web site at www.utcourts.gov under employment opportunities. An application for judicial office form must be completed and is available on the court’s Web site. The part-time position offers an annual salary between $39,645 and $71,361. The appointment is subject to confirmation by the Riverdale City Council and certification by the Utah Judicial Council.

      Salt Lake City, UT—Utah State Court Administrator Daniel J. Becker has announced the appointment of Diane Abegglen to the position of trial court executive for Utah’s Appellate Courts. Abegglen replaces Matty Branch who retired in April. The Appellate Courts include the Court of Appeals and the Utah Supreme Court. 

      Prior to joining the courts, Abegglen worked for United States Bankruptcy Court, District of Utah. She has held management positions in Salt Lake City and Phoenix, Arizona, with the American Arbitration Association. Abegglen has also worked as a law clerk with the Utah Supreme Court. She is a graduate of the University of Utah College of Law and has a graduate degree in counseling and a bachelor’s degree in education from Idaho State University. 

As trial court executive, Abegglen is responsible for the administration of the Appellate Courts, which includes providing administrative support to justices and judges and managing support operations of professional and technical staff. In addition, the trial court executive is responsible for overseeing case management, court facilities, court security, and the court’s budget in the Appellate Courts.

Public comments are being accepted from 4 to 4:30 p.m. Following the public hearing, the meeting is closed to allow commission members to select a slate of five candidates for the vacancy.

Summer Convention in Sun Valley was a marvelous success!  Thank you to our speakers and presenters for an educational and motivating summer getaway.  In Justice Clarence Thomas' keynote address, he spoke about his duties and the isolation the nine justices feel as they serve on the nation's high court.  He said that speaking to groups like ours, "allow(s) me to come out and see the people who really matter in our government, and that is you all."  Justice Thomas was refreshingly humorous and upfront in his address.  Truly, the bar has been set high as we plan future events.  We fully expect that you are making plans now to join us at the 2011 Summer Convention July 7th through July 9th in San Diego, California.  Convention planners are already busy putting together another stellar group of speakers and CLE events that you won't want to miss.

1.     <strong>Annual Award Recipients</strong> - The Bar wishes to congratulate<strong> Judge Robert Hilder</strong> who was selected as Judge of the Year and <strong>Judge Pam Greenwood</strong> who was recognized with a Distinguished Judicial Service Award.  <strong>Randy Dryer</strong> was awarded Lawyer of the Year.  Each of these award recipients has a long history of professionalism, public service and personal dedication to the building up of the legal profession.  Also given awards at the 2010 Summer Convention were the <strong>Bar Examiner Committee</strong> and the <strong>Military Law Section</strong> as Committee and Section of the year, respectively.
  
2.      <strong>Utah Supreme Court Committee Vacancy</strong>  -  The Supreme Court is seeking applicants for an attorney to serve on the Civil Procedures Committee.  Applicants should be experienced in civil litigation and the rules of procedure.  To apply, submit a letter of interest and a brief resume to Tim Shea at tims@email.utcourts.gov or Administrative Office of the Courts / P.O. Box 140241 / Salt Lake City, Utah 84114-0241.  The deadline for applications is August 30th.  To help stagger the terms of all committee members, the initial appointment will be for two years and for four years thereafter.  The committee meets about nine times per year, usually on the fourth Wednesday of the month, from 4:00 to 6:00 in the Administrative Office of the Courts at the Matheson Courthouse. 3.     <strong> 2010 Fall Forum Awards</strong> - The Board of Bar Commissioners is seeking nominations for the 2010 Fall Forum Awards. The award categories include Distinguished Community Member Award, Professionalism Award, Pro Bono Lawyer of the Year. 4.     <strong> Change to Utah Rules of Civil Procedure 64D. Writ of garnishment</strong>  -  Effective July 1, 2010 garnishees are no longer required to file a copy of completed answers to interrogatories with the clerk of the court.  Answers to interrogatories must still be filed with the plaintiff/judgment creditor and defendant/employee as well as any other person shown by the records of the garnishee to have an interest in the property.       <![CDATA[Riverdale, Utah—Applications are being accepted for a Justice Court judge position in Riverdale City. The position will replace Judge Michelle E. Heward who has been nominated by Governor Gary Herbert for a Juvenile Court judgeship in the 2nd Judicial District. 
 
To be considered for the position, candidates must be at least 25 years of age, a citizen of the United States, a Utah resident for at least three years, and have earned a high school diploma or GED. 

Information on judicial retention and performance evaluation is posted on the Utah State Court’s Web site at <a href="http://www.utcourts.gov ">www.utcourts.gov </a>under employment opportunities. An application for judicial office form must be completed and is available on the court’s Web site. The part-time position offers an annual salary between $39,645 and $71,361.       SALT LAKE CITY – Governor Gary R. Herbert has appointed four attorneys to the bench in the Second Judicial District, which serves Davis, Morgan and Weber counties.

“The people of the Second District will be well served by these four future judges,” Governor Herbert said. “Each has excelled in his or her legal career and each comes highly recommended by the bar and bench.”

      ·           Michelle E. Heward, Juvenile Court Judge, Weber County

Ms. Heward is a full-time professor of criminal justice at Weber State University and a Justice Court judge. She has previously served as a Deputy County Attorney in Weber County, where she screened cases involving juvenile defendants, and as a private attorney in a general law practice.

Ms. Heward has a juris doctorate from the University of Utah College of Law. She has been appointed to replace Juvenile Court Judge L. Kent Bachman, who will retire Aug., 1, 2010.

·           Jeffrey J. Noland, Juvenile Court Judge, Davis County

Mr. Noland currently serves as a managing attorney for the Salt Lake Office of the 

Guardian ad Litem. Prior to joining that office in 2006, he was in private practice, representing parents in juvenile court in abuse, neglect and termination proceedings filed in juvenile court.

Mr. Noland has a juris doctorate from the University of Utah College of Law. He has been appointed to replace Juvenile Judge Stephen Van Dyke, who retires on Aug. 16, 2010.

·           David R. Hamilton, District Court Judge, Davis County

Mr. Hamilton is in private practice in Ogden, and focuses on mediation, personal injury, insurance defense and domestic cases. His also has experience in the area of criminal defense. Prior to his solo practice, Mr. Hamilton was a partner at Smith, Knowles &amp; Hamilton in Ogden.

Mr. Hamilton has a juris doctorate from the University of Utah College of Law. He has been appointed to replace Judge Jon Memmott, who retired May 1, 2010.

·           Noel S. Hyde, District Court Judge, Weber County

Mr. Hyde currently practiced privately in South Ogden, primarily in small business 

matters, bankruptcy and commercial litigation. Prior to starting his own practice in May 2001, he was a domestic and general litigator with the firm Nielsen &amp; Senior.

Mr. Hyde has a juris doctorate from Brigham Young University’s J. Reuben Clark Law School. He has been appointed to replace Judge Pamela Heffernan, who retired June 1, 2010.

The Governor’s appointments are subject to confirmation by the Utah Senate.
