Utah Supreme Court Travels to BYU Law School

UTAH SUPREME COURT TO HEAR ORAL ARGUMENTS AT
J. REUBEN CLARK LAW SCHOOL

WHAT: The Utah Supreme Court periodically holds court sessions in other locations to provide an opportunity to enhance public understanding of the court’s work and to provide law students with an opportunity to see the Supreme Court in session.

Cases to be heard are as follows: (A summary of the cases is attached to the e-mail.)

Jeffs v. West, case no. 20110207-SC

Thayer v. Washington County, case no. 20100648-SC

WHEN: Wednesday, November 2, 2011, at 10:00 a.m. to approx. 12:00 p.m.

WHERE: J. Reuben Clark Law School, Brigham Young University

WHO: Utah Supreme Court Justices: Chief Justice Christine M. Durham, Associate Chief Justice Matthew B. Durrant, Justice Thomas R. Lee, Justice Ronald E. Nehring, and Justice Jill N. Parrish.

Meeting set to select new Justice Court Judge

JUSTICE COURT JUDICIAL NOMINATING COMMISSION

SELECTION MEETING PLANNED

Parowan, UT---The Iron County Judicial Nominating Commission has scheduled a meeting on Nov. 15, 2011, to select candidates to replace Judge Kenneth H. Adams who retired on Sept. 30, 2011. The commission will meet beginning at 11:30 a.m. at the Parowan Public Library, 16 South Main.

Four Nominees Named for Vernal Justice Court Vacancy

NOMINEES ANNOUNCED FOR VERNAL JUSTICE COURT VACANCY

Vernal, UT—The Uintah County Nominating Commission has selected four nominees for an upcoming vacancy in the Vernal Justice Court. The position will replace Judge Pat McRae who is retiring Dec. 31, 2011.

Following are the nominees for vacancy followed by place of employment and residence:

· E. Jed Labrum, Anderton & Labrum, P.C., Vernal

· Rachelle L. Palmer, Dennis L. Judd, P.C., Vernal

· Ray R. Richards, 8th District Juvenile Court, Vernal

· JoAnn B. Stringham, Allred, Brotherson & Harrington, Vernal

A comment period will be held through Nov. 10, 2011, before a final candidate is selected byVernal City Mayor Gary Showalter, who has 30 days to make an appointment, which is subject to ratification by the Vernal City Council. MESSAGE FROM PRESIDENT ROD SNOW
The Millennial Generation

On Monday, October 31st, the Utah courts administered the attorneys’ oath to over 320 new graduates. We extend a warm welcome and congratulations to each new Utah attorney. They join our ranks during challenging economic times. They will need our support and guidance. In the spirit of our New Lawyer Training Program, I hope each of you will take some time to mentor our new lawyers.

Most of our new lawyers are “Millennials” – the generation born between 1980 and 2000. The Millennial Generation is emerging in the legal workplace as our associates and employees. Some observers of this generation have suggested they are the most difficult group with which to work. However, as a group, I find the Millennials are bright, optimistic, yearn for meaning in their work and for work-life balance. They have an unprecedented ability to use technology and multi-task. Working with them can produce excellent results for clients. They are willing to tackle most any project, even if it is beyond the scope of their experience and/or knowledge. And when that is the case, more often than not, they do a good job. Most appreciate guidance and they all work well where collaboration is required. SALT LAKE CITY – The Utah State Bar is prepared to welcome some 400 lawyers to its 2011 Fall Forum, which will feature workshops, awards and a keynote address from two of Utah’s most inspiring attorneys.

The 2011 Fall Forum begins with an evening reception on Thursday, Nov. 17 and a lively performance of “A Mid Summer Night Mediation Tragedy” that explores the undesirable effects of a “misguided, ego inflated and poorly presented mediation.”

Utah State Bar Members,

We are conducting research with attorneys holding an active status license on a variety of topics of interest to members of the Bar. The survey will cover topics ranging from law practice economics, technology, advertising, the Courts, public perception of lawyers, and the Utah State Bar. Attorneys will randomly be questioned on just some of the topics to keep the time it takes to complete the survey short, but with the expert assistance of Dan Jones & Associates, we will obtain reliable results. Individual responses will be anonymous.

Starting in mid-November, attorneys will receive an electronic and postcard invitation to participate in this study, which will run through mid-December. The survey will take less than 10 minutes to complete. Thank you to the Litigation and Intellectual Property Sections for helping to support this survey.

We appreciate you taking the time to complete this. To that end, survey participants will be entered into a drawing for 1) a free iPad or 2) free registration to the Spring Convention, Annual Meeting and Fall Forum in 2012 (~1/400 chance of winning).

Notice of Approved Amendments to Utah Court Rules

The Supreme Court has approved amendments to the following Utah court rules. The amendments are effective December 1, 2011.

Summary of amendments

Restyled Rules of Evidence. Consistent with the restyling of the Federal Rules of Evidence, the language of these rules has been amended as part of the restyling of the Evidence Rules to make them more easily understood and to make style and terminology consistent throughout the rules. These changes are intended to be stylistic only. There is no intent to change any result in any ruling on evidence admissibility.
