Notice of Proposed Amendments to Utah Court Rules

The Supreme Court invites comments to proposed amendments to the following court rules. The comment period expires June 21, 2011.

Summary of proposed amendments

The Civil Rules Committee has been working on extensive amendments to the rules, and particularly the discovery rules, in an effort to reduce the cost and delay of civil litigation. The draft rules were informally published in June 2010, and members of the committee met with lawyers and judges throughout the state to explain the rules and seek comments and suggestions. The informal comment period ended in December 2010.

Since then, the committee has reviewed and discussed all comments, and the draft rules were revised in response to some of them. The most significant changes were to specify “tiers” of standard discovery based on the amount at issue in the litigation and to provide parties with the choice of receiving a report from an opposing expert, or taking a 4-hour deposition of the opposing expert.

The draft rules are now being officially published, and comments will be accepted during the 45-day comment period. The committee will consider all comments received, make further changes to the rules if warranted, and then send its recommendations to the Supreme Court.

Announcement of JUDICIAL VACANCY May 4, 2011

Applications are now being accepted for the position of district court judge in the Third Judicial District.
(Counties include Salt Lake, Summit, and Tooele).
This position results from the pending retirement of Judge Joseph C. Fratto, Jr., December 16, 2011.
Completed application forms must be received by the Commission on Criminal and Juvenile Justice
no later than 5:00 p.m., Thursday, June 9, 2011.

Selection Process
Utah law requires the Judicial Nominating Commission to submit five nominees to the Governor within 45 days of its first meeting. The Governor has 30 days in which to make a selection. The Utah State Senate has 60 days in which to approve or reject the governor's selection. To obtain the procedures of Judicial Nominating Commissions and the names of Commission members call (801) 538-1856.
At its first meeting the Nominating Commission reviews written public comments. This meeting is open to the public. To comment upon the challenges facing Utah's courts in general, submit a written statement no later than June 9, 2011 to the Commission on Criminal and Juvenile Justice, Attention: Third District Judicial Nominating Commission.

NOMINEE NAMED TO FILL FILLMORE CITY JUSTICE COURT VACANCY

Fillmore, UT—Fillmore City Mayor Eugene Larsen has appointed Judge Stanley K. Robison to fill a vacancy on the Fillmore City Justice Court. The position replaces Judge Ronald R. Hare who resigned effective Jan. 1, 2011.

Judge Robison has served as the Delta City Justice Court judge since 1983, and worked in the petroleum products distribution business for more than 36 years. He currently works part-time for the Millard County Road Department as well as the Stephenson Honey Company. In 1970, Judge Robison received a Bachelor of Science degree in Accounting/Business Education/Economics from Brigham Young University.

NOMINEE NAMED TO FILL LEHI CITY JUSTICE COURT VACANCY

Lehi, UT—Lehi City Mayor Bert Wilson has appointed Judge Paul C. Farr to fill a vacancy on the Lehi City Justice Court. The position will replace Judge Garry Sampson who has announced his resignation effective May 31, 2011.

Judge Farr has served as the Herriman City Justice Court judge since 2010. Judge Farr is a partner in the Salt Lake law firm of Morgan, Minnock, Rice & James, L.C. He received an Associate of Science degree in History from Dixie State College and a Bachelor of Science degree in Criminal Justice from Weber State University. Judge Farr received his Juris Doctorate degree from Brigham Young University in 1999.

Utah State Bar elects new leaders

SALT LAKE CITY — Lori Nelson, a partner at the law firm of Jones Waldo Holbrook & McDonough, has been elected president of the Utah State Bar for 2012-13.

She will serve as president-elect for 2011-12, replacing Rodney Snow, who will take over as president in July. Nelson will become president in July 2012.

Nelson served five years on the bar's Executive Committee.

Also in the recent elections, Utah State Bar members selected commissioners to serve three-year terms representing Third Division and First Division areas of the state.

In the Third Division — Salt Lake, Tooele and Summit counties — Dickson Burton was re-elected, and Eve Furse and Robert Rice were elected as new commissioners. In the First Division — Cache, Box Elder and Rich counties — Herm Olsen was re-elected.

2011 Bar Elections and Online Licensing

The Utah State Bar 2011 elections are now complete. Lori W. Nelson has been elected as our new President-elect. She will follow Rod Snow, who will take over as Bar president in July. Elected in the Third Division are H. Dickson Burton, Evelyn J. Furse and Robert O. Rice. Herm Olsen will continue to represent lawyers in the First Division. We want to thank the fine lawyers who were willing to campaign and serve. We also want to thank all who voted and participated in the process

The annual Bar licensing renewal process will begin in June and will be done only on-line. Sealed cards will be mailed the first week of June and will include a login and password to access the renewal form and the steps to re-license. No separate form will be sent in the mail. Licensing forms and fees are due July 1st and will be late August 1st. If you need to update your email address of record, please contact onlineservices@utahbar.org. If you do not have an e-mail address or do not use e-mail, you may receive a printed licensing form by contacting licensing@utahbar.org.

Meeting Set to Selected Holladay Justice Court Judge

MEETING PLANNED

Holladay, UT---The Salt Lake County Judicial Nominating Commission has scheduled a meeting on May 20, 2011, to select candidates to replace Judge Daniel B. Gibbons who has announced his resignation effective July 5, 2011. The commission will meet at noon at the Holladay City Hall, 4580 South 2300 East, in the Mt. Olympus Room.

JUDICIAL DISTRICT COURT OF GARFIELD COUNTY WILL BE MOVING

Please take notice that the Sixth Judicial District Court Of Garfield County will be moving from the current location at 55 South Main St, Panguitch Utah on May 13, 2011. A new court facility will be constructed at the current court location.

The temporary address for the court office will be 740 North Main, PO box 77, Panguitch, Utah. All court hearings will be held in the Panguitch city council chambers at 25 south 200 east Panguitch, Utah. During the construction period the hours of operation will temporarily be changed. The new hours will be 8:00 am to 5:30 pm Monday - Thursday at 740 North Main. All court hearings scheduled with the court will be at the Panguitch City Council chambers 25 South 200 East Panguitch, Utah.

For court assistance call 435-676-1104 Monday – Thursday. For immediate assistance on a Friday call 435-676-8585 where a court clerk can be reached.
