COURT OF APPEALS JUDICIAL VACANCY ANNOUNCED

Salt Lake City, Utah—Applications are now being accepted for a vacancy on the Utah Court of Appeals bench. The position will replace Judge Russell Bench who will retire effective Dec. 31, 2009.

To be considered for the position, candidates must be at least 30 years of age, a citizen of the United States, a resident of Utah for at least five years, and admitted to practice law in Utah.

Information on benefits, judicial retention, and performance evaluation is posted on the Utah State Courts’ Web site at www.utcourts.gov under employment opportunities. Application packets are available by contacting Margo Bird or Cheryl Breneman at (801) 578-3800.

Applications should be returned to the attention of Margo Bird, Administrative Office of the Courts, P.O. Box 140241, Salt Lake City, UT 84114-0241, or faxed to (801) 238-7814. Applications must be received by Jan. 5, 2010 at 5:00 p.m.

Utah law requires the Judicial Nominating Commission to submit seven nominees to the Governor within 45 days of its first meeting. The Governor has 30 days in which to make a selection. The Utah State Senate has 60 days in which to approve or reject the Governor’s selection.

In Tough Economic Times, Try Unbundling Your Legal Services

Many potential clients cannot afford to hire us to handle their legal issues from a - z. Unbundled Legal Services, also known as Limited Scope Representation, is a growing trend in the legal profession where a lawyer may provide specific legal tasks for a client, while the client remains self-represented in the matter as a whole. A lawyer and client may agree to limit the lawyer's services to things like appearing in court for a specific hearing, counseling on legal rights, advising the client about procedures, or helping to draft documents. The relationship must be by specific, informed agreement. These limited relationships are permitted under the Rules of Professional Conduct if they follow specific guidelines and provide a way for greater access to the courts by those who need legal assistance but cannot afford more comprehensive help. 5th Judicial District Courthouse to Open Dec. 14

NEW ST. GEORGE COURTHOUSE TO OPEN DOORS DECEMBER 14

St. George, UT—The new Fifth Judicial District Courthouse is scheduled to open its doors for business at 206 Tabernacle on Monday, Dec. 14, 2009.

Since construction began in February 2008, work has been steady to build the 91,734 sq. ft., $29 million facility. The courthouse includes eight courtrooms for use by the district and juvenile courts. In addition, office space for district and juvenile courts, juvenile probation, the Office of Guardian ad Litem, and mediation is located in the courthouse.

UTAH SUPREME COURT ANNOUNCES APPOINTMENT TO
JUDICIAL CONDUCT COMMISSION

Salt Lake City, UT---The Utah Supreme Court has appointed Judge Carolyn B. McHugh to serve on the Judicial Conduct Commission, filling the balance of the term of Judge Russell W. Bench, who is retiring from the bench December 31, 2009. Judge Bench’s term on the Commission expires July 30, 2012. At that time, the Utah Supreme Court will consider reappointing Judge Carolyn McHugh for a four-year term.
