Announcement of Judicial Vacancy

That applications are now being accepted for the position of juvenile court judge in the Third Judicial District. (Counties include Salt Lake, Summit, Tooele).

This position results from the creation of a new Judicial position by the Utah State Legislature.

Court Commissioner for Second Judicial District Court

$49.52/hr (approximately $103,000/year) plus benefits

Applications are currently being accepted for a Court Commissioner position in the Second District Court. The Court Commissioner is a quasi-judicial officer as provided by the Utah Code and the rules of the Judicial Council. This position will assist the Second District Court with domestic hearings and other duties under the direction of the presiding judges as permitted by statute and rule of the Judicial Council.

FOURTH DISTRICT JUDICIAL NOMINATING COMMISSION SELECTION MEETING PLANNED

Provo, UT---The Fourth District Judicial Nominating Commission has scheduled a meeting for March 16, 2007 at 9:30 a.m. in the law library at the Provo Courthouse, 125 North 100 West. The purpose of the meeting is to nominate a candidate to replace Fourth District Court Judge Anthony Schofield who announced his retirement from the court effective April 30, 2007.

UTAH COURT OF APPEALS HEADS TO CEDAR CITY

Salt Lake City, Utah-The Utah Court of Appeals is heading south to Cedar City for a special session of the court on April 5 at 10:30 a.m. The court will hear oral arguments at the Southern Utah University, 351 West University Blvd., general classroom GC408. The last time the Court of Appeals heard oral arguments in Cedar City was Oct. 30, 2000.

"Utah's two appellate courts-the Court of Appeals and Supreme Court-hear cases primarily in Salt Lake's Scott M. Matheson Courthouse," said Judge Gregory K. Orme "Both courts, however, on occasion will travel to hear cases in other parts of the state to give the public and students an opportunity to see the how the court operates first hand."

The panel that will preside during oral arguments is comprised of Judge Carolyn B. McHugh, who has served on the Court of Appeals since 2005; Judge Gregory K. Orme, who has served on the Court of Appeals since 1987; and Judge William A. Thorne, Jr., who has served on the Court of Appeals since 2000.

The Utah Court of Appeals was created in 1987 to handle an increasing load of appellate cases facing the Utah Supreme Court. The court, which consists of seven judges who serve six-year renewable terms, hears appeals primarily from the juvenile and district courts. UTAH SUPREME COURT TO HEAR ORAL ARGUMENTS AT U OF U

Salt Lake City, Utah—The Utah Supreme Court will hear oral arguments in the Sutherland Moot Courtroom at the S.J. Quinney College of Law on the University of Utah Campus on March 28, 2007 at 9 a.m. The Utah Supreme Court holds court each spring at the University of Utah to provide an opportunity to enhance public understanding of the court’s work and to provide students with an opportunity to see the Supreme Court in session.

The cases the court has scheduled to hear are as follows: at 9:30 a.m. Ellis v. The Estate of Ellis (Supreme Court Case No. 20060359-SC) and at 10:30 a.m. State of Utah v. Brandon Williams (Supreme Court Case No. 20060517-SC). Copies of the briefs filed in these cases are available at the Appellate Clerks Office in the Matheson Courthouse, 450 South State.

The Utah Supreme Court is the “court of last resort” in Utah. The court hears appeals from capital and first-degree felony cases and all district court civil case other than domestic relations cases. The Supreme Court also has jurisdiction over judgments of the Court of Appeals, proceedings of the Judicial Conduct Commission, lawyer discipline, and constitutional and election questions. The Supreme Court is comprised of the following five justices: Chief Justice Christine M. Durham, Associate Chief Justice Michael J. Wilkins; Justice Matthew B. Durrant; Justice Jill N. Parrish, and Justice Ronald E. Nehring.

JUDICIAL NOMINATING COMMISSION SELECTS NOMINEES FOR FOURTH DISTRICT COURT VACANCY

Provo, UT---The Fourth District Judicial Nominating Commission has selected five nominees for a vacancy in the Fourth District Court. The position will replace Judge Anthony Schofield who will be leaving the court to return to private practice on April 30, 2007. The Fourth Judicial District is comprised of Juab, Millard, Utah, and Wasatch counties.

The nominees are as follows: Lorie D. Fowlke, Provo, Scribner & McCandless; Thomas L. Low, Heber, Wasatch County Attorney; Darold McDade, Pleasant Grove, Assistant Attorney General; Leslie Slaugh, Orem, Howard, Lewis and Peterson.

A 10-day public comment period will be held before the names are submitted to Gov. Jon M. Huntsman Jr. Fourth District Nominating Commission Chair Kevin Worthen is accepting written comments regarding the nominees at Administrative Office of the Courts, P.O. Box 140241, Salt Lake City, UT, 84114-0241. The deadline for written comments is 5 p.m. on April 5, 2007.

The commission may request further interviews or an investigation of the nominees after reviewing public comments. After the public comment period, the names will be sent to the governor who has 30 days to select a candidate. The Governor's nominee is then forwarded to the Senate Confirmation Committee, which reviews the nominee's qualifications and conducts a public hearing and interview session. The Senate Confirmation Committee will forward the final nominee to the Utah State Senate, which has 60 days from the Governor's nomination to confirm the nominee.

Notice of Proposed Amendments to Utah Court Rules

The Supreme Court invites comments to proposed amendments to the following court rules. The comment period expires May 18, 2007.

Summary of proposed amendments

Rules of Criminal Procedure
URCrP 40. Search warrants. Amend. The changes incorporate procedural provisions from the Utah Code on search warrants. The changes also create procedures to implement the requirements of Anderson v. Taylor, 2006 UT 55. The rule requires a magistrate to retain search warrant documents from the time a search warrant is issued. The rule also addresses access to and sealing of search warrant files. Approved as an expedited amendment under Rule 11-101(6)(F). Subject to further change after the comment period. Effective Date: April 30, 2007.

PRESIDING JUDGES NAMED IN FOURTH JUDICIAL DISTRICT

PRESIDING JUDGES NAMED IN FOURTH JUDICIAL DISTRICT

Provo, UT---Judge Derek P. Pullan has been named presiding judge for the Fourth District Court effective March 2007. Judge Pullan replaces Judge Anthony Schofield who is retiring from the court to return to private practice. Judge Samuel D. McVey has been named associate presiding judge.

Gov. Michael Leavitt appointed Judge Pullan to the Fourth District Court in September 2003. Judge Pullan received a law degree from Brigham Young University, J. Reuben Clark Law School in 1993, graduating cum laude. He worked as a law clerk at the Utah Supreme Court from 1993 to 1994 and as a deputy county attorney in Washington and Wasatch counties from 1994 to 1999. Judge Pullan was appointed and subsequently elected to serve as the Wasatch County Attorney from 1999 to 2003. He is a member of the American Inns of Court.

Gov. Olene Walker appointed Judge McVey to the Fourth District Court in April 2004. Judge McVey graduated with distinction from the United State Naval Academy in 1977 with a Bachelor of Science degree in Naval Engineering. He received a law degree from Brigham Young University, J. Reuben Clark Law School in 1983, graduating magna cum laude. Judge McVey served in the United States Marine Corps from 1977 to 1989 and again from 2003 to 2004, where he was an artillery officer and judge advocate. He was a partner in the law firm of Kirton & McConkie from 1989 to 2003 and volunteered as a judge pro tem from 1994 to 2003.

The presiding judge is responsible for the effective operation of their court. According to court Rule 3-104, presiding judges are responsible for implementation and enforcement of statutes, rules, policies, and directives of the Judicial Council as they pertain to the administration of the courts. The presiding judge is responsible for assigning cases and judges. Presiding judges and associated presiding judges are elected by a majority vote of the judges of their court. When the presiding judge is unavailable, the associate presiding judge assumes his or her responsibilities.

Young Lawyers Division Annual Clothing Drive

The Young Lawyers Division of the Utah State Bar is holding its annual clothing drive from April 9, 2007 through April 13, 2007. We are collecting gently used business and business casual clothing to be donated to the Thrift on 33rd. This non-profit organization distributes used business clothing to low-income and homeless adults in the community to assist them in re-entering the work force.
