S.J. Quinney College Of Law Selects New Dean

Dear Members of the Utah Bar,

For those of you who did not learn about this in the newspaper or otherwise, I am delighted to report that Hiram Chodosh has been offered and accepted the position of Dean of the S.J. Quinney College of Law. Dean Chodosh generated a huge amount of excitement among every single law school constituency. Approved Amendments - URCP, URAP & CJA

The Supreme Court and Judicial Council have approved amendments to the following Utah court rules.

Summary of amendments

Rules of Civil Procedure
URCP 004. Process. Amend. In conjunction with repealing Rule 71B, permit case to proceed against parties who are served.
URCP 006. Time Amend. Permit 3 additional days in which to respond if notice is served by mail, fax, or electronic service.
URCP 062. Stay of proceedings to enforce a judgment. Amend. Establishes an automatic 10-day stay on enforcing a judgment.
URCP 064C. Writ of attachment. Amend. Permits a writ of attachment when the writ is authorized by statute.
URCP 068. Offer of judgment. Amend. Changes name of rule to "Settlement offers." Authorizes expert witness fees and expenses and deposition recordings as part of award of "costs" if a settlement offer is rejected and the offeree's position does not improve after trial. Makes results of failure to improve bi-directional.
URCP 071. Process in behalf of and against persons not parties. Renumber and Amend. In conjunction with repealing Rule 71B, renumber Rule 71A as Rule 71. Gender neutral text.
URCP 071B. Proceedings where parties not summoned. Repeal. Repeal as contrary to due process.

FOURTH DISTRICT JUDICIAL VACANCY ANNOUNCED

Provo, Utah-Applications are now being accepted for a District Court judge in the Fourth Judicial District, which includes Juab, Millard, Utah, and Wasatch counties. The position is newly created by the Utah State Legislature.

To be considered for the position, candidates must be at least 25 years of age, a citizen of the United States, a resident of Utah for at least three years, and admitted to practice law in Utah.

Call for Historical Bar Photos

In celebration of the 75th Anniversary of the Utah State Bar, the Bar Journal board is considering placing a montage of historical Utah Bar photos on the Bar Journal cover for a special issue scheduled for publication in the fall. Examples of old photos we have in mind would be early group photos of bar members, judges, and photos of bar offices, court houses, and the like.
